- #221614:59upheld Jay Dyer psogos: ad hominem (+1) tempered from flagrant to minor
The council upheld the call, but nothing on this stream goes on anyone’s record.
“You need a husband. Why are you worrying about all this stuff? Find a husband. You're worried about... This philosophy is not for you. Just go find a husband. Stop worrying about metaphysics and philosophy. It's not for you.”
Diogenes: Ariana had raised a point about whether objective morality grounds theism; instead of answering it, Jay dismissed her as unfit for philosophy and in need of a husband, which her argument does not rest on, nothing in the debate backs, and which ended the call as he moved straight to the next caller.minor: A blatant personal dismissal that took the place of any engagement and closed the exchange outright.
Herodotus (partly): I couldn't retrieve the earlier debate (egmU5n0kVM4). The YouTube page returned no transcript, and a web search found nothing on Ariana. The site's records show she has no scored debates, so the only history is Jay's remark in this transcript: "You've called in before... You were a Calvinist two years ago, so you're an atheist now." That suggests a prior call and a change in her views. It is unverified, and it doesn't justify the personal dismissal. Jay's record here is heavy with upheld ad hominem (x19 over 24 debates), and in the same call he made a similar jab at Ancient Dolphin ("male vitality", "lisp"). So this looks like his habitual pattern rather than a response to anything Ariana did. His complaint that her position had shifted was a possible substantive point, but he used it to dismiss her rather than answer her. Sources: https://www.youtube.com/watch?v=egmU5n0kVM4 The bench graded it major (Aristotle, Plato); the referee had flagrant.
- Aristotle uphold: On the record: Jay Dyer opened as host of an open forum taking calls on theology and philosophy, and held that role; he never answered Ariana's point on objective morality, and the called line swaps that answer for a remark about her marital status and fitness for philosophy. Substitution: Ariana's point was cut off and left unanswered. Relevance: her argument does not rest on whether she has a husband. Truth: nothing in the debate backs the remark. Aim: it closed the exchange, and he went straight to the next caller. His comment about her Calvinist-to-atheist shift was a possible substantive point, but he used it to dismiss her rather than answer her. Because the insult is mild and the shift is on the record, the severity should be major, not flagrant.
- Socrates uphold: Read blind, found "ad hominem". Ariana had begun an argument: objective morality is itself an object, so it doesn't ground theism. Jay never answered it. He cut her off with her past (a Calvinist, now an atheist) and told her to "find a husband" because philosophy "is not for you." That remark is about her person and sex, not her point. Her argument doesn't rest on those traits. Nothing in the debate backs the claim that she is unfit for philosophy. It ended the exchange on her point and turned to her instead.
- Plato uphold: On the record: Jay Dyer opened as host of an open forum, promising to take calls on popes, plagues and pandemonium. He declared no thesis and gave no answer to Ariana's point. The called line fits how he treated callers throughout, which was to dismiss them personally. Ariana began an argument about objective morality and theism. Jay did not answer it. He told her to find a husband and said philosophy is not for her, then moved to the next caller. That is a remark about the person standing in place of an answer. Her argument does not rest on her marital status or her fitness for philosophy, and nothing in the debate supports the remark. It ended the exchange. His earlier jab about her Calvinist past could have been a fair point about her consistency, but he used it to dismiss her instead of engaging. The elements are met. I lower the severity to major because the call was short and the reason it gave for flagrant is not fully borne out.
The bench voted on this, and its verdict is kept as it was given. It does not vote on the calls of a call-in show now, and nothing there counts on anybody’s record.
