Appeal: misused source

- #22662:28:55overturned S19 claim: misused source (+1)
The council overturned the finding, so nothing is marked against Speaker 19.
The claim, as Thucydides noted it: Dr. Daniel Canty (name as heard) holds a PhD in Reformed and Augustinian theology from Yale, lives near Nashville, and has appeared on David Patrick Harry [David Bentley Hart]'s show. quote corrected
Diogenes: Thucydides (verifier): not found; the source does not bear what is drawn from it. The caller (S19) asserts at 147:09 and 148:47 that "he has a PhD in reformed and Augustine theology from Yale," that he "lives near Nashville," and was "on David Patrick Harry show." My search found no Daniel Canty with such a degree, and the name was only heard, so the spelling may be wrong. The transcript shows the caller said it but does not verify it. A PhD does not by itself show that Reformed theology is incompatible with Augustine and apostolic tradition, so the drawn conclusion rests on his say-so and not on a source.- Aristarchus (transcript) corrected: "David Patrick Harry" is most likely David Bentley Hart, the theologian whose universalist, anti-penal-substitution views fit the talk of PSA and law versus grace; "Canty" is left alone because the minutes give no clear correction.
- Aristotle overturn: On the record: S19 (a late caller, Braden) declared no thesis; he only recommended a friend, Dr. Daniel Canty, as a useful contact for Jay Dyer against Protestantism and Latin scholasticism, and the called biographical line is consistent with that role. The verifier's finding is "not found", which the rubric says to judge as if there were no finding. The name was only heard, so the spelling may be wrong. The line is a passing biographical claim about a friend, not a source carrying a disputed conclusion, and nothing in the debate shows it false. The fault is not shown, so the call is overturned.
- Socrates overturn: Read blind, found nothing worth calling. S19 gives factual background on a friend's credentials and a podcast appearance. Jay does not dispute it, and it is not offered as the ground of a contested claim. Nothing on the floor is answering an argument here, so there is no fault or merit to score.
- Plato overturn: On the record: S19 entered late as a caller with no declared thesis beyond urging Jay to contact a friend whose theses attack Protestantism and Latin scholasticism. The called line is that friend's credentials, and it is a stated aside rather than a departure from that purpose. The verifier's finding is "not found", with the name only heard and possibly misspelled. A failed search does not show the claim false, and the rubric says a contested or not-found finding is judged as if there were no finding. The speaker is vouching for his friend's credentials, and nothing in the record contradicts him. The line does not draw a conclusion from a source in a way that can be shown misused. It is a toss-up whether any fault exists, so the call is overturned.
The bench voted on this, and its verdict is kept as it was given. It does not vote on the calls of a call-in show now, and nothing there counts on anybody’s record.
